The McCraw Law Group has established a $1,000 scholarship in order to support future lawyers who have an interest in public safety issues in our civil justice systems.
The criminal justice system exists to keep individual citizens safe and maintain order. The expectation is that the system will uphold our society’s criminal laws: to protect the innocent, punish the guilty and prevent future crimes. The civil justice system exists not only to provide an imperfect proxy to repay individuals who are harmed by the negligent acts of others but also to keep individual citizens safe from the dangerous choices of others.
Civil litigation also ensures public safety as being a deterrent against grievous acts, as well as providing financial recourse for victims to help pay for their medical treatment. For instance, if police officers use excessive force, they can face not only criminal charges but also civil lawsuits to recover for any damages they have caused. These civil suits will inform insurance companies’ decisions on whether to continue providing liability coverage to the police force. In fact, police departments in California, Ohio and Pennsylvania have been closed because the insurance company withdrew their coverage. To prevent this, departments are being forced to eliminate corruption and get rid of the offenders and insurance companies often offer incentives for making positive changes, such as using body cameras and providing extra training. These indirect means of pressuring the police force to become more accountable makes the community safer.
Likewise, in private industry, civil lawsuits have been at the forefront of exposing corruption and poor safety choices that have led to needless severe injuries and deaths. From automobile manufacturers, medical device manufacturers, pharmaceutical marketing to insurance bad faith litigation the civil justice system provides exposure of public safety problems and an avenue for the solution to problems as they develop.
