Holding Manufacturers Accountable

Product liability is a legal term that refers to the liability of all parties in the chain of manufacture for damage caused by a product. If you have been injured by a defective consumer product, consult with an experienced product liability attorney about a claim for compensation.

How Can Consumer Products Be Defective?

Under product liability laws, manufacturers and sellers can incur liability for any of three types of product defects:

Design Defects:

These are defects inherent in the design of the product before it is manufactured. Examples include electric appliances that melt on high settings, top-heavy cars prone to roll over, structurally unstable furniture, and toys that pose choking hazards for children.

Manufacturing Defects:

When something goes wrong in the manufacture or construction of a product, manufacturing defects can occur. Typically, only a few products of the same type are defective. Examples include improperly machined parts, improperly calibrated electronic components, missing components, and products assembled incorrectly.

Marketing Defects:

Labeling or marketing defects occur when manufacturers fail to provide proper instructions for using the product or to warn consumers of dangers. Potentially hazardous products must come with adequate warning labels to inform consumers. Misleading advertisements and inadequate use instructions can also give rise to marketing defect liability.

How Many Injuries Are Caused by Defective Products?

After an 18% decrease in 2020, injuries related to consumer products increased by 6.8% in 2021 and by 7.8% in 2022. A total of 12.7 million people in the U.S. were treated in emergency rooms for consumer product injuries, as stated by the National Safety Council (NSC). Many of these injuries were sustained by young children and older adults.

What Types of Products Cause Injury to Consumers?

Most consumer product injuries in 2022 involved everyday products assumed to be safe, such as household cleaning products, televisions, and beds.

The top three categories for product-related injuries were:

  • Stairs, landings, floors, and ramps (2.9 million injuries) – most injuries from slips and falls.
  • Beds, mattresses, and pillows (906,000 injuries)
  • Sofa beds, sofas, and chairs (597,000 injuries)

Among children ages zero to four, the top three product categories for consumer injuries were:

  • Soaps and detergents (13,171 injuries)
  • TVs and TV stands (6,388 injuries)

Who Is Liable for Injuries Caused by Defective Products?

Designers, manufacturers, wholesalers, and retailers may all play a part in a product’s distribution chain. However, manufacturers have a duty to indemnify sellers against losses arising from product liability claims unless they were caused by negligence, misconduct, or another act or omission of the seller under the Texas Civil Practice and Remedies Code, Title 4, Chapter 82. Although injured consumers may hold sellers independently liable for any injuries sustained due to their actions, liable parties in most Texas product liability claims are product manufacturers.
