Pursuing the Claim
As soon as the injury occurs, there are several potential steps to take. First, anyone injured should seek immediate medical care. Even if the injury does not seem serious at the time, proper medical treatment can uncover any hidden symptoms and document the extent of the injuries.
Second, the police should be called to the scene of all injuries. The police are required to produce an incident report of any situation that involves an injury. This accident report is an impartial accounting of the events that led to the injury in Anna.
Third, be very cautious when speaking with a defendant’s insurance representative. These conversations are all recorded, and plaintiffs can unwittingly damage their cases with statements made to the defendant’s insurance company. As soon as an injured person hires an attorney, the insurance company can only discuss the case with that attorney.
Time is of the essence in all claims alleging personal injury. According to Texas Civ. Prac. and Remedies Code 16.003, there is a statute of limitations of two years on all personal injury claims. This means that if a lawsuit is not filed in court within two years of the incident, the plaintiff will be unable to pursue their claim.
